RULING ON MOTION FOR SUMMARY JUDGMENT AND ORDER

BRADY, District Judge.

This matter is before the Court on cross motions for summary judgment (docs. 18 & 28) filed by North River Insurance Company (“North River”) and Pro Sources, Inc. (“Pro Sources”) respectively. Both motions for summary judgment have been opposed. There is no need for oral argument. This case was originally filed in Louisiana state court and removed to this Court under 28 U.S.C. 1441.
