Belator was appointed a member of the civil service commission of the city of Spokane, March 24, 1927, for the term of six years. The city council of that city, April 19,1929, passed a resolution requiring relator to show cause why he should not be removed from office. Believing that the city council was acting without authority in proposing to consider and determine the question of his removal from the office of civil service commissioner, relator applied to the superior court for' a writ of prohibition requiring the city council to desist from proceeding further with the matter.
