This is a petition for letters of administration upon the estate of an absentee who is alleged to have disappeared from his residence in Brooklyn on March 15, 1921, and not to have been since heard from. The petitioner predicates her application, in part, upon subdivision 2 of section 119 of the Surrogate’s Court Act, as amended by chapter 229 of the Laws of 1929. It will be noted, however, from section 21 of this chapter (page 519) *862that this amendment applies only to the estates of persons dying after August 31, 1930, for which reason it is not applicable to the instant case.
