The first objection raised by Defendants upon the trial of this action, is that the complaint does not state facts sufficient to constitute a cause of action. The complaint alleges that on the 16th of November, 1859, he was the owner and in possession of one span of horses, double set of harness, and neck yoke, of the value of $267, *191wbicb property was exempt by law from attachment or execution, it being the only team and tackle therefor owned by the- Plaintiff.
