OPINION

{¶ 1} Defendant-appellant, Elwood W. Forbes, appeals his conviction in the Preble County Court of Common Pleas for possession of cocaine. For the reasons outlined below, we affirm in part, reverse in part, and remand.

{¶ 2} On March 4, 2006, Trooper Shaun Smart of the Ohio State Highway Patrol observed an SUV with a California license plate following a semi-truck too closely on eastbound U.S. Interstate 70 in Preble County.
