Mary Peacock, born June 20, 1959, brought this action, through her guardian ad litem, for personal injuries. Plaintiff is suffering from a form of cerebral palsy, known as choreo-athetosis, as a result of which she has no voluntary control of her arms and legs.

When plaintiff was 3 months old, on September 16, 1959, she was admitted to Madigan Army Hospital for breathing difficulties. At that time a tracheotomy was performed; it was discovered she had a swelling in her throat which was the cause of her trouble, but no diagnosis was made of the exact cause of the trouble until later.
