MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Children’s Memorial Hospital (“Children’s Memorial”) sues the Illinois Department of Public Aid (“IDPA”) and its Director Jeffrey Miller (“Miller”) for declaratory and injunctive relief under 42 U.S.C. § 1983 (“Section 1983”), 1 alleging Illinois’ Medicaid reimbursement plan and formula, Ill.Rev.
