Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered July 12, 1996, upon a verdict convicting defendant of the crime of promoting prison contraband in the first degree.
While an inmate at Elmira Correctional Facility in Chemung County, defendant was charged with the crime of promoting prison contraband in the first degree after he was found in possession of a sharpened piece of plastic pipe.
