On April 3, 2015, Plaintiff Tony’s Pantry Mart Inc. #1 (“Tony’s Pantry”) filed a Complaint and Petition for Review of the Food and Nutrition Service’s (“FNS”) Final Agency Decision permanently disqualifying Tony’s Pantry from participating in the Supplemental Nutrition Assistance Program. (“SNAP”).1 See 7 U.S.C. §§ 2021(b)(3)(B), 2023(a)(13).
