Thomas H. Langham, receiver of McFaddin-Wiess-Kyle Land Company, appellee, on the 9th day of February, 1915, filed this suit as an action of trespass to try title against the Texas Rice Land Company, appellant. On the 4th day of October, 1915, appellee filed his-amended petition as an action of trespass to try title, seeking to recover all of the David A. Cunningham survey except the portion conveyed to W. P. H. Mc-Faddin by Chaison and Hebert and a small portion used as a right of way by the'Texas & New Orleans Railway Company, and, in addition to the ordinary form of such action, set up…
