Pearl Teller, hereinafter called plaintiff, recovered a judgment in the circuit court of Shelby county for three thousand two hundred fifty ($3250) dollars. The defendant, Yellow Cab Company,- has appealed.

The plaintiff, while riding as a passenger in a cab owned and operated by the defendant on the streets of Memphis, Tennessee, was injured. The accident occurred April 15, 1927. The plaintiff was returning to her home in Memphis, she had been on a visit to Forrest City, Arkansas, she arrived at nighttime at the Grand Central Station.
