*43■ This action was commenced October 13, 1911, by Christensen, defendant in error, designated hereinafter as plaintiff, against James S. Ferguson and his wife, plaintiffs in error, spoken of as defendants, to recover a balance-alleged to be due him as contractor for constructing a dwelling house, barn and other improvements for James S. Ferguson, and to foreclose a mechanic’s lien upon the premises, the title to which stands in the name of his wife. Trial was to the court which awarded plaintiff a personal judgment against James S. Ferguson in the sum of $711.45, and entered a decree…
