In this consolidated action 1 the United States seeks the return of sums paid to the defendants by the Department of Agriculture through the Commodity Credit Corporation, under authority purportedly granted by 7 U.S.C. A. § 1446(c). Plaintiff contends that such payments exceeded the authority granted the Secretary of Agriculture by the statute, and thus the government is entitled to repayment of the monies disbursed, with interest from the date of the allegedly unauthorized payment, or .at least from the date of the government’s first demand for repayment. 2…
