Presently before the Court is the second or renewed motion to dismiss plaintiffs complaint filed by defendants Michael W. Colton Trust, Michael W. Colton, P.C., and Michael W. Colton (hereinafter “Colton defendants” or “moving defendants”). Previously, on January 13, 1999, this Court issued a memorandum opinion and order granting in part and denying in part Col-ton defendants’ original motion to dismiss complaint.
