This action was instituted in the district court of Tulsa county by the defendant in error, as plaintiff, against the plaintiff in error, as defendant. The action was to recover damages for an injury sustained by the plaintiff by reason of an automobile collision between the car in which lie was riding and a car being driven by one Clelen Douglas. It was alleged that the collision was caused by the negligence of Douglas, who was the agent and employee of the defendant, and who was acting within the scope of his employment at the time of the collision which resulted in injury to the plaintiff.
