Appeal from an order and judgment of the Supreme Court at Special Term (Hughes, J.), entered February 1, 1985 in Schenectady County, which granted defendant’s motion for summary judgment dismissing the complaint.
This wrongful death action based on medical malpractice was commenced by the service of a summons and complaint on defendant on February 22, 1984.
