BRIGHT, Senior Circuit Judge.
A.L. Lockhart, Director of the Arkansas Department of Corrections, appeals from a district court 1 order granting relief to Sharon Anita Bliss on her petition for a writ of habeas corpus. The district court’s order directed the State of Arkansas to retry Mrs. Bliss within ninety days; otherwise, the writ of habeas corpus would issue. Lockhart contends the district court erred in granting relief without conducting an evidentiary hearing and because Mrs. Bliss’ claims were procedurally barred. We reject these contentions and affirm.
