The plaintiff, Charles Goodpaster, brought this action to restrain Oklahoma Gas & Electric Company, herein referred to as “O. G. & E.”, from erecting poles, for an electric transmission line, upon a utilities easement over lots in a residential development in The Village, Oklahoma.
