The matter before the Court is defendant PHH Homequity Corporation’s Demurrer. The Court took the matter under advisement after a hearing on May 10, 1991.

The pertinent facts for the disposition of this motion are as follows and are taken as established for purposes of this Demurrer. Burns v. Board of Supervisors, 218 Va. 625, 627 (1977); Duggin v. Adams, 234 Va. 221, 223 (1987).
