— Appeal from a judgment of the Supreme Court at Special Term, entered August 23, 1978 in Albany County, which dismissed petitioner’s application in a proceeding pursuant to CPLR article 78 seeking to compel respondent to credit time in the custody of the Narcotic Addiction Control Commission pursuant to certification against a subsequent sentence of imprisonment.
