OPINION AND ORDER

Pending before the Court is Defendant Ruben Blade’s (“Defendant”) Motions to Dismiss. (Docket Nos. 12, 13). For the reasons set forth below, the Court DENIES Defendant’s Motions.
FACTUAL AND PROCEDURAL BACKGROUND
On January 22, 2003, Plaintiff William Anthony Colon (“Plaintiff’) and Defendant signed an Engagement Contract with DIS-SAR Production (“DISSAR”) where both Plaintiff and Defendant agreed to perform at a musical concert, in San Juan, Puerto Rico.
