MEMORANDUM OPINION AND ORDER
LAKE, District Judge.
Plaintiff, Bankruptcy Trading & Investments, L.L.C. (“BTI”), brought this action against defendant, Chiron Financial Group, Inc. (“Chiron”), for breach of fiduciary duty and professional malpractice arising out of a business relationship between the parties, the purpose of which was to take control of a debtor in bankruptcy. BTI originally brought its action in the 269th District Court of Harris County, Texas (Plaintiffs Original Petition, Docket Entry No. 9).
