OPINION

FUTEY, Judge.

This case comes before the court after briefing and an evidentiary hearing held on April 20, 2004. On November 8, 2002, the court issued an Order and Opinion denying defendant’s motion to dismiss and cross-motions for summary judgment. In the opinion, the court noted that “[t]he nature of the property interest and the scope of the alleged appropriation are disputed and the court would benefit from further ventilation of these issues.” Cmty.
