This is an appeal from a judgment in favor of the plaintiff in a garnishment action. The facts out of which the litigation grew and. the facts relating to the proceedings had in the action are substantially as follows:

In 1934 the garnishee, Sell, owned a business establishment known as the Community Bar, then in operation in the city of Grafton in this state.
