In October, 1942, the city of Kankakee filed in the circuit court of Kankakee county its complaint praying an injunction issue against the New York Central Railroad Company, appellant, to abate an alleged nuisance. The complaint alleges the existence of an ordinance prohibiting anyone in charge , of any smokestack of a locomotive or other machine, or of a chimney in any building, from allowing the emission of dense smoke for a period aggregating six minutes in the hour, or allowing the escape from any smokestack in the open air of such quantities of ash, dust, cinders, or other material or…
