Empyrean Investment Fund, L.P. (“EIF”) has moved to intervene in two adversary proceedings pending before this Court involving the Trustee and Creditors Committee of Market XT Holdings Corp. (collectively, the “Trustee”). One proceeding involves claims between the Trustee and E*Trade Financial Corp. (“E*Trade”), which are incorporated in counterclaims filed by the Trustee against E*Trade.
