MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiff Nilsa M. Ruiz-Rivera brings this complaint against A.D. Moyer, District Di*871rector of the Immigration and Naturalization Service (“INS”) alleging a violation of her due process rights. INS now moves to dismiss the complaint, or, in the alternative, for summary judgment. For the reasons stated below, defendant’s motion for summary judgment is granted.1
