John Booker, the plaintiff in error, instituted an action of trespass on the case in assumpsit against L. Gr. Donohoe in the Circuit Court of Elizabeth City county, and filed a declaration containing the common counts in assumpsit, and a special count, which sets forth the following cause of action, to-wit: That on the 25th day of May, 1893, he was duly elected to the office of county clerk of Elizabeth City county, and was thereby entitled to the certificate of election and to enter upon the discharge of the duties of the said office on the first…
