The order entered September 30, 2014 denied defendant's motion pursuant to CPLR 3211 to dismiss the complaint as time-barred under CPLR 215 (3). The order entered February 27, 2015 denied defendant's separate motions for summary judgment dismissing the complaint and to compel discovery pursuant to CPLR 3124, respectively.
