Plaintiff-appellant has appealed from a judgment quashing an execution issued in the amount of $43,260, based upon an alleged judgment in that amount obtained by plaintiff-appellant (hereinafter called plaintiff) against defendant-respondent, Oscar Janssen (hereinafter called defendant).
