STAKELY, Justice.
J. W. Crum died intestate on October 7, 1947, being killed in an automobile accident. He was a resident of Butler County at the time of his death and left surviving him his widow Mattie Irene Crum and ten sons and daughters namely: Ima Crum Nixon, J. B. Crum, Bertha Rea Horton, W. E. (Earl) Crum, Rachel Crum *165Jones, Velma Lee Crum Ryland, Effie Mae Crum Harris, Jesse Leon Crum, Elmer Heral Crum and Charles Roland Crum. The three children last named are minors.
