These consolidated cases are the sequence of a credit sale of a Chevrolet automobile by Bates-Crumley Chevrolet Company, Inc., now the Howard Crumley Company, Inc., to George Bryson, on June 27, 1933, and its alleged subsequent tortious conversion by said company. Negotiations between the parties antedated the consummation of the sale. Bryson delivered to the company his old car and. after being paid in cash a part of its trade-in value, left the remainder in the company’s hands to be applied on the price of a new car.
