The above-entitled cause is now being determined as an error proceeding by reason of plaintiff’s appeal on questions of law from the judgment of the Court of Common Pleas of Franklin County, Ohio.

The petition was filed October 18, 1939, and therein plaintiff sought judgment against the defendant in the sum of $10,000.00, with interest from the 2nd day of May, 1939, on an insurance policy issued by the defendant and in force on May 2, 1939, at the time of an incident allegedly covered by the insurance policy, whereby a boiler was completely destroyed.
