On January 28, 1904, appellee recovered a judgment against appellant Charles Kelley in the Noble Circuit Court, for $5,018.33, on which execution was issued January 30, 1904, to the sheriff of Dekalb county, and return of nulla bona was made thereon February 5, 1904. On February 8, 1904, appellee brought this action in the Dekalb Circuit Court, supplementary to execution under our statutes, against said judgment defendant Charles Kelley and his coappellants, his son Hersehel C.
