In this action respondent, plaintiff below, seeks judgment against the defendant L. Wessler and appellant, Salt Lake- Ogden Transportation Company, for alleged damage for injuries to his automobile.

The complaint charges Wessler with negligently and at an excessive rate of speed operating a Ford truck upon the highway, and alleges that by reason of such negligence Wessler collided with the automobile being driven by respondent, causing the injuries complained of.
