Defendant, Chayse R. Keller, appeals from the dismissal of his “Petition for Declaratory Judgment.” He asked the trial court to find that the Department of Corrections was misapplying the mandatory supervised release (MSR) provision of the Unified Code of Corrections (730 ILCS 5/5 — 8—1(d) (West 2000)) in interpreting his sentence. He now asserts that the court erred in dismissing his petition summarily pursuant to section 122 — 2.1 of the Post-Conviction Hearing Act (Act) (725 ILCS 5/122 — 2.1 (West 2002)).
