FOLEY, District Judge.

Defendants’ Motions were consolidated pursuant to Rule 12, Subdivision (g), Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c.

Defendants’ Motion to Dismiss is based upon the contention that only legal conclusions have been pleaded.

In Paragraph 15, Subdivision V, Page 5 of the Complaint, it is alleged: “Beginning in or about the year 1934, and continuing thereafter up to and including the date of the filing of this Complaint, the defendants have contracted and have been and now are engaged in a combination and conspiracy unreasonably to restrain, and…
