HARWOOD, Presiding Judge.
This- appellant stands convicted of assault with intent to murder. The victim of the assault was Mr. S. R. Wallace.
*662It is clearly inferable from the evidence that the shooting of Mr. Wallace by the appellant grew out of a family row, Mr. Wallace’s son, Clifton, being married to the sister of the appellant. This marriage apparently has been beset with trials and tribulations.
The evidence presented by the State tends to show that the appellant drove into the yard of Mr. Wallace’s home in rural Jefferson County on the afternoon of 28 March 1959. Clifton, the son of Mr.…
