Mark Garmon, a student at a private university, brought a civil rights action under 42 U.S.C. § 1983 alleging that Robert Foust, a municipal police officer, violated his Fourth Amendment rights by unlawfully seizing and searching without a warrant a package that had been mailed to Garmon, but which was undelivered and in the custody of university employees at the time the officer took possession of it.
