Tilson, Judge:

The plaintiff filed this suit seeking to recover a certain sum of money alleged to have been illegally exacted as customs duties on imported merchandise. There is some indication that the merchandise was classified as finished or partly finished articles of which compounds of casein, known as galalith, is a component material, not specially provided for, by virtue of the similitude provisions contained in paragraph 1559, and duty was levied thereon at the rate of 40 cents per pound and 50 percent ad valorem under paragraph 33 of the act of 1930.
