Appellee, Dan McCunningham, instituted this suit March 30, 1910, against the Texas & Pacific Railway Company, the Kansas City, Mexico & Orient Railway Company, the Kansas City, Mexico' & Orient Railway Company of Texas, and the Missouri Pacific Railway Company for several thousand dollars’ damages to a shipment of cattle made from Toyah, Tex., to Sedan, Kan., April 19, 1909.
