The parties to this action will be referred to as they appeared in the lower court; that is, the plaintiff in error as defendant, and the defendant in error as plaintiff. This is an action arising on a fire insurance policy issued by tbe defendant to tbe plaintiff on a stock of merchandise located at Tishomingo, Okla. Tbe policy in question was issued on tbe 7th day of October, 1914, for tbe sum of $2,150, and in consideration of the issuance of said policy by the defendant tbe plaintiff paid as a premium therefor tbe sum of $16.12.
