It is alleged that at all times in question plaintiffs were the owners and occupants of a home located at 602 Stockton court, in the city of Madison; that defendant construction company during the months of August and September, 1939, was engaged in excavation incidental to-the construction of an apartment building located about three hundred feet from the plaintiffs’ property.
