*659The plaintiff Salvatore Piro (hereinafter the plaintiff) consulted the defendant Jerzy Macura (hereinafter the defendant), a physician, in May 2003, to be evaluated for weight loss surgery and for treatment of an umbilical hernia. The defendant recommended that the plaintiff undergo a laparoscopic banding (lap band) procedure to treat his obesity and that his umbilical hernia be repaired. The lap banding was conducted on November 12, 2003, and the umbilical hernia was repaired on May 7, 2004.
