MEMORANDUM OF DECISION AND ORDER ON DEFENDANT’S MOTION TO DISMISS

SARIS, District Judge.

The plaintiff, Irving Laker, has brought this eleven count complaint against the defendant, William Freid, seeking recovery under federal securities laws, the civil Racketeer Influenced and Corrupt Organizations Act (RICO), the Massachusetts Consumer Protection Act, and assorted common law theories.
