In this appeal from a traditional summary judgment, Jewelry Manufacturer’s Exchange contends the trial court erred in granting summary judgment in favor of Herman Tafoya and in subsequently dismissing the case. We reverse the summary judgment and remand this case to the trial court for further proceedings. Background
