OPINION

WECHSLER, Judge.

1. Defendant appeals from the judgment and sentence of the trial court sentencing him on multiple felony counts. He argues-that the Double Jeopardy Clause prohibits sentencing him for both assault with intent to commit a violent felony, murder, NMSA1978, § 30-3-3 (Repl.Pamp.1994), and for aggravated battery with a deadly weapon, NMSA1978, § 30-3-5(0 (Repl.Pamp.1994).
