R.D. Columbia Associates, L.P. (“Columbia”), appeals from a final judgment entered in the United States District Court1 for the Eastern District of Missouri upon a jury verdict finding them liable to William Ashley and Hugh Nisbet (“plaintiffs”) for injuries resulting from a carbon monoxide poisoning incident. For reversal, Columbia argues that the district court erred in (1) denying its motion for judgment as a matter of law based on sufficiency of the evidence, (2) allowing plaintiffs to refer to punitive damages in opening statement and prohibiting defense counsel…
