This is the second appeal in this case (70 Texas, 56). The facts are very clearly and succinctly stated in the opinion which was delivered on the former appeal. The evidence was precisely the same upon the two trials, except that upon the latter additional testimony was introduced which tended to show that the path which crossed the railway at the point at which deceased was standing when he was struck by the engine was in general and continual úse by persons going between Bichmond and the farms and residences between that town and the next station on the east.
