Defendant, St. Paul Union Stockyards Company, appeals from a judgment and from an order denying its alternative motion for judgment notwithstanding the verdict or a new trial.

In the trial court, the jury returned a verdict in favor of plaintiff, Walter L. Bonniwell, for damages incurred in a mishap which occurred on May 16, 1962, when he fell partway into a manhole at the St. Paul stockyards.
